James Comey Avoids Charges -- In Lieu Of Bigger Ones Still To Come

Yesterday, investigative journalist John Solomon of The Hill broke an exclusive story discussing the investigation into former FBI director James Comey. According to Solomon,

"Inspector General (IG) Michael Horowitz's team referred Comey for prosecution under the classified information protection laws, but Department of Justice (DOJ) prosecutors working for Attorney General William Barr reportedly have decided to decline prosecution -- a decision that's likely to upset Comey's conservative critics."

Apparently the DOJ prosecutors thought Horowitz's evidence was compelling, but decided not to bring charges because they felt that there was not enough evidence to show Comey's intent. It is kind of funny that one of Comey's reasonings for not filling charges against Hillary Clinton back in 2016 was because he couldn't determine her intent as well.

According to one of Solomon's sources, one concern about the evidence was that the memo Comey gave to his friend to leak to the media, was classified at the lowest level, which is called "confidential". The memo itself also wasn't technically classified until after Comey handed it over to his friend. Solomon's source said, the DOJ didn't want to, 

"make its first case against the Russia Investigators with such thin margins and look petty and vindictive."

Even though it seems like Comey is out of the woods, there are still ongoing investigations by Inspector General Horowitz and U.S. Attorney John Durham. These investigations relate to how the Russia probe started, as well as potential Foreign Intelligence Surveillance Act (FISA) violations during Trump's 2016 campaign. Another one of Solomon's sources said,

"There are significant issues emerging with how the FISA was handled and other conduct in the investigation, and everyone involved remains under scrutiny."

When the "Horowitz Report" comes out in the next few weeks it is said to contain condemnations of how Comey handled classified information and Solomon says that it will conclude that,

"the former FBI director improperly took with him memos that were FBI property when he was fired, transmitted classified information via an insecure email account, and shared some of the memos with his private lawyers."

On July 25 the FBI released documents to Judicial Watch that showed notes made by FBI officials who went to Comey's home to retrieve the memos he took with him. In the notes there is no mention of Comey telling them he shared the memos with a friend. Though there wont be any charges for Comey, this does start to tarnish his "perfect image."

As we continue to get drips and drops of information about these ongoing investigations, one thing is clear. This particular set of investigators are taking their investigations very seriously. Hopefully we the people will get the answers we deserve sooner rather than later.
